End User License Agreement
1. Agreement
This End User License Agreement (“EULA”) is between you and ACMscope Inc. (“we”, “us”) for the ACM software. By installing, activating or using ACM you accept it. If you do not accept, do not use ACM.
2. License grant
Subject to payment and compliance with this EULA, we grant you a limited, non-exclusive, non-transferable, non-sublicensable license to install and use ACM on Windows devices, within the plan you purchased. ACM is licensed, not sold.
3. Plans and entitlements
Your plan (Essential, Essential+, Pro, Pro+ or the Pro 7-Day Trial) determines the features and capacity available, such as replay charts, open-position symbols and tracked instruments, as described on the ACM website at the time of purchase. Features of a higher plan are not included in a lower one.
4. Activation
ACM uses license activation and validation. Each license may be activated on up to two (2) devices. If you need to change a device, contact support. License keys must not be shared, sold or sublicensed.
5. Perpetual licenses
A perpetual license is a one-time purchase with no recurring charge and no fixed expiry date, subject to this EULA. It covers the ACM version you received and updates we release within that version. We are not obliged to provide new major versions or additional features free of charge.
6. Pro 7-Day Trial
The trial grants access to Pro features for 7 days from first successful activation. It is one-time, does not renew, and cannot be repeated or extended. When it expires, Pro features stop working unless you buy a plan. The trial fee is not credited toward any purchase.
7. Restrictions
You may not: copy, redistribute, resell, rent or lend ACM or your license key; reverse engineer, decompile or modify ACM except where law expressly allows; bypass, disable or tamper with licensing or activation controls; remove proprietary notices; use ACM to provide a commercial service to third parties; or use ACM unlawfully.
8. No trading or advisory service
ACM is a technical-analysis and charting tool. It is not a broker, investment adviser, financial adviser, portfolio manager or trading service. It does not execute, modify or close trades. Its output, including scanner verdicts, indicators and divergence readings, is not financial, investment or trading advice and is not a prediction of market movement.
9. Requires MetaTrader 5; market data
ACM requires MetaTrader 5. Market data and positions come from your MT5 terminal and broker and may be delayed, incomplete, unavailable, differently named or limited in historical depth, varying by broker, instrument and timeframe. We do not control broker data quality or availability. Verify information before making financial decisions.
10. No guarantee; risk
ACM is provided without any guarantee that analysis, indicators, alerts, scanner results or other outputs will be accurate, complete, uninterrupted or profitable. Past performance does not guarantee future results. Trading, particularly of leveraged products and CFDs, carries a high risk of loss and you are solely responsible for your decisions.
11. Third-party services and trademarks
ACM depends on MetaTrader 5, broker services, Gumroad and other third-party systems outside our control. MetaTrader is a trademark of MetaQuotes; ACM is not affiliated with or endorsed by MetaQuotes or any broker.
12. Ownership
ACM, its software, documentation, branding and related intellectual property remain our property or that of our licensors. This EULA does not transfer ownership.
13. Privacy and support
Our Privacy Policy describes how we handle information. Support: support@acmscope.com. Refunds are governed by our Refund Policy.
14. Disclaimer and limitation of liability
To the maximum extent permitted by law, ACM is provided “as is” without warranties other than those that cannot lawfully be excluded, and we are not liable for trading losses, lost profits or indirect or consequential loss. To the maximum extent permitted by law, our total liability arising from ACM is limited to the amount you paid for the purchase giving rise to the claim. Nothing excludes or limits any liability or consumer right that cannot lawfully be excluded or limited.
15. Termination
This license ends automatically if you materially breach this EULA, including by bypassing licensing or redistributing ACM. On termination you must stop using ACM and remove it from your devices.
16. Changes to this EULA
We may update this EULA for future versions or purchases; the “last updated” date shows the current version.
